Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and ReliableUptime ("Company", "we", "our", or "us") governing your access to and use of the uptime monitoring service available at reliableuptime.com and any associated mobile or desktop applications (collectively, the "Service").

By creating an account or using the Service in any way, you confirm that you are at least 16 years of age, have the legal capacity to enter into this agreement, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

ReliableUptime provides an uptime and performance monitoring platform that enables users to:

  • Configure automated checks of websites, APIs, and network endpoints.
  • Receive real-time alerts via email, webhooks, and other notification channels when monitored endpoints become unavailable or degrade.
  • Track incidents, view historical uptime data, and generate reports.
  • Publish public or private status pages to communicate service health to stakeholders or end users.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. Accounts

3.1 Registration

To use most features of the Service, you must register for an account by providing a valid email address and creating a password. You agree to provide accurate, current, and complete information and to keep it up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at hello@reliableuptime.com if you suspect any unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.

3.3 One Account Per User

Each individual may maintain only one free account. Creating multiple free accounts to circumvent plan limits is prohibited.

4. Subscription Plans and Payment

4.1 Plan Types

We offer the following subscription tiers: Free, Pro, and Team. The features, limits, and pricing for each plan are described on our Pricing page and may be updated from time to time.

4.2 Billing and Renewal

Paid plans are billed monthly in advance. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. Payment is processed by Stripe and is subject to Stripe's terms of service.

4.3 Free Trial

We may offer a free trial period for paid plans. At the end of the trial, your subscription will automatically convert to the paid plan unless you cancel before the trial ends. You will be notified before any charge is applied.

4.4 Price Changes

We reserve the right to change our pricing at any time. Any price changes will apply to the next billing cycle after we provide at least 30 days' written notice to affected subscribers via email.

4.5 Taxes

Prices are exclusive of applicable taxes. You are responsible for all taxes associated with your subscription.

5. Cancellation and Refunds

5.1 Cancellation

You may cancel your paid subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will continue to have access to paid features until the end of the period for which you have already paid.

5.2 Refunds

We generally do not offer refunds for unused portions of a subscription period. However, if you experience a significant Service outage or are unsatisfied with the Service for any reason within the first 30 days of a new paid subscription, you may request a full refund by contacting hello@reliableuptime.com. Refund requests are evaluated on a case-by-case basis.

5.3 Account Deletion

You may delete your account at any time. Upon deletion, your data will be removed from our active systems within 30 days, subject to our retention obligations described in our Privacy Policy.

6. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Monitor endpoints that you do not own or do not have explicit permission to monitor.
  • Use the Service to conduct denial-of-service attacks, stress testing, load testing, or any activity intended to disrupt or degrade a third-party service or network.
  • Use the Service to scrape, harvest, or extract data from third-party websites in violation of their terms of service.
  • Circumvent, disable, or interfere with security-related features of the Service.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Use the Service in any way that violates applicable laws or regulations, including privacy laws and export control regulations.
  • Resell, sublicense, or provide access to the Service to third parties without our written consent.
  • Use automated means to create accounts, access the Service, or circumvent usage limits.

We reserve the right to suspend or terminate your account immediately if we determine, in our sole discretion, that you have violated this Acceptable Use policy.

7. Service Level and Uptime

We strive to maintain high availability for the Service and target 99.9% uptime for our monitoring infrastructure. However, we do not guarantee any specific uptime or response time. Scheduled maintenance will be announced in advance where possible.

The Service is provided as a monitoring tool and is not a substitute for your own infrastructure monitoring, redundancy planning, or disaster recovery procedures. You should not rely solely on the Service for critical operations.

8. Intellectual Property

8.1 Our Content

The Service and its original content, features, functionality, trademarks, logos, and code are owned by ReliableUptime and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8.2 Your Content

You retain ownership of any content you submit to the Service, such as status page text and incident descriptions ("Your Content"). By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute it solely as necessary to provide the Service.

You represent and warrant that Your Content does not violate any third-party rights and complies with these Terms.

8.3 Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use such feedback without restriction or compensation to you.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.

10. Third-Party Services and Advertising

The Service may integrate with or link to third-party services (e.g., payment processors, SMS providers). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.

Our marketing website (reliableuptime.com) displays advertisements served by Google AdSense. Google AdSense may use cookies and similar technologies to serve ads based on your browsing activity. By using our marketing website, you acknowledge that Google may collect and use data in accordance with Google's Privacy Policy. You can manage your ad preferences via the cookie banner on our website or at Google Ads Settings.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT THE SERVICE WILL DETECT ALL OUTAGES OR INCIDENTS, THAT ALERTS WILL BE DELIVERED WITHOUT DELAY, OR THAT MONITORING DATA WILL BE ACCURATE OR COMPLETE AT ALL TIMES. NETWORK CONDITIONS, THIRD-PARTY INFRASTRUCTURE, AND OTHER FACTORS OUTSIDE OUR CONTROL MAY AFFECT SERVICE PERFORMANCE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RELIABLEUPTIME BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $100.

13. Indemnification

You agree to indemnify, defend, and hold harmless ReliableUptime and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable laws. Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration or, where arbitration is not available, through the courts of competent jurisdiction.

Before initiating any formal proceedings, we encourage you to contact us at hello@reliableuptime.com to attempt to resolve the dispute amicably.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a prominent notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, upon reasonable notice. Reasons for termination include, but are not limited to, violation of these Terms, non-payment, extended inactivity, or requests from law enforcement.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including intellectual property rights, disclaimers, and limitations of liability.

17. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and ReliableUptime regarding the Service and supersede all prior agreements.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
